The Law on Import and Export Regulations<\/strong>\u00a0ratified on September 26th<\/sup>, 1993, should be considered as the principal source of\u00a0export and import law in Iran<\/strong>.<\/p>\n

According to the\u00a0Iranian law<\/strong>, there are three types of goods, in light of the\u00a0export and import<\/strong>\u00a0as follows:<\/p>\n

    \n
  1. The goods and commodities which their\u00a0import or export<\/strong>\u00a0is allowable and admissible even without obtainment of the prerequisite license (permissible goods).<\/li>\n
  2. The goods and commodities that\u00a0the import or export<\/strong>\u00a0requires the obtainment of the license from\u00a0Iranian authorities<\/em>\u00a0(conditional goods), and<\/li>\n
  3. The goods and commodities that their\u00a0import or export<\/strong>\u00a0is forbidden and prohibited under the\u00a0Islamic rules or the laws and regulations of Iran<\/strong>\u00a0(prohibited goods).<\/li>\n<\/ol>\n
    <\/span>How we should learn about the actual feasibility of importing and exporting of the special goods in Iran?<\/h5>\n

    The General Office for Export and Import Regulations of the Ministry of Mine, Industry and Trade<\/strong>, on an annual basis, publishes the\u00a0Export \u2013 Import Regulations\u00a0in order to provide the fast and easy access to the updated information in\u00a0terms of import and export.<\/p>\n

    The annual\u00a0Export \u2013 Import Regulations of Iran regulates<\/strong>\u00a0the updated customs duties as well as commercial benefit taxes on the different groups of commodities.<\/p>\n

    Considering the current un-employment rate of Iran which is much higher than the international standards, one of the main concerns of the Iranian authorities is to support domestic production by permitting\u00a0importation of the necessary raw materials and the cutting edge machinery<\/strong>.<\/p>\n

    In order to support the domestic products,\u00a0the importation of the raw materials<\/strong>\u00a0and the intermediates products which have been domestically produced in Iran, has a higher rate of commercial benefit tax which annually defined by\u00a0the Export \u2013 Import Regulations<\/strong>.<\/p>\n

    <\/span>The role of the Commercial Card in Iran<\/strong><\/h5>\n

    As a prerequisite of performing\u00a0trade business in Iran<\/em>, the traders are required to obtain\u00a0the Commercial Card<\/strong>\u00a0which has been issued by the Iranian Chamber of Commerce. The applicant of\u00a0the Commercial Card<\/strong>\u00a0could be an individual or a company.<\/p>\n

    <\/span>The facilities provided for the importation of the raw materials and goods which are used in domestic production<\/strong><\/h5>\n

    According to Article 12 of\u00a0the Iran import and Export Law<\/strong>, the importation of raw materials and goods which are supposed to be used in the domestic productions is exempted from payment of\u00a0the import duties and costs<\/em>. These types of goods, are also exempted from obtainment of the required licenses as set forth in the annex of\u00a0the Export \u2013 Import Regulations<\/strong>.<\/p>\n

    Even if the imported goods, have been exported without any changes or transformation, the importer is subject to the facilities of the above-mentioned article.<\/p>\n

    <\/span>The necessity of \u201cOrder Registration\u201d and \u201cImport License\u201d issued by the Ministry of Industry, Mine and Trade of Iran for all of the importable goods<\/strong><\/h5>\n

    According to article 5 of\u00a0the Executive Ordinance of law on Export and Import<\/strong>, all of the importable goods, to be\u00a0imported to Iran<\/em>, are required to obtain the\u00a0order registration<\/strong>\u00a0and\u00a0import license<\/strong>. The following goods are exempted from such a procedure:<\/p>\n

      \n
    1. The goods which are required by the families residing in Borden towns and by sailors and vessel crew, within the limits of the list set out in the ordinance;<\/li>\n
    2. Special military goods;<\/li>\n
    3. The goods of the arrival passengers within the legal limitation;<\/li>\n
    4. The imported goods through the mail post service within the legal limitation;<\/li>\n
    5. The commercial samples;<\/li>\n
    6. The samples of goods which are aimed to be presented in the international exhibitions.<\/li>\n<\/ol>\n

      The goods which are totally prohibited to be imported to Iran<\/strong><\/p>\n

        \n
      1. The alcoholic drinks (all types and models);<\/li>\n
      2. The gambling tools;<\/li>\n
      3. The weapons, ammunitions and explosive materials;<\/li>\n
      4. Narcotic drugs;<\/li>\n
      5. All the materials such as magazines, photos, movies and etc. which are in contradiction to the official religion of Iran.<\/li>\n
      6. Any other goods and commodities prohibited by the authorities in accordance to the laws and regulations of Iran on a permanent or temporary basis.<\/li>\n<\/ol>\n
